  1. Introduction
    1. This website https://www.edenbraehomes.com.au (the “Site”) is owned and operated by Eden Brae Holdings Pty Limited (ABN 42 083 807 489) (“EBH”). EBH is a licensed builder (Licence Number 120300C).
    2. These are the terms and conditions which govern your use of the Site. In addition to these website terms of use, the following terms also constitute the whole agreement between you and EBH:

      1. EBH Privacy Policy;

      2. EBH Disclaimer;

      3. Any other terms and conditions EBH provides to you from time to time.

    3. You should always check these terms and conditions every time you visit the Site as EBH may make changes to it from time to time without letting you know.
  2. Photography and illustrations
    1. Images used within the Site are for illustrative purposes only and may depict upgrade options for homes which may incur additional charges. You should refer to floor plan brochures or working drawings for specific details. Otherwise please feel to Contact EBH.
    2. Some images may also depict features not supplied by EBH including but not limited to landscaping, pools, water features, window furnishings, fireplaces, wall furnishes and finishes, cladding, in built joinery, decorative lighting, décor, furniture and flat profile roof tiles (some of these items may be available at an additional cost, so please feel free to Contact EBH).
    3. Facade details such as entry doors, window sizing and placement may also vary between house types and sizes. Once again, you should refer to floor plan brochures or working drawings for specific details.
    4. EBH reserves the right to vary floor plans, home specifications and prices without notice to you.
  3. Variations and advertised pricing
    You acknowledge and agree that:

    1. The advertised prices for homes may change as a result of variations to the inclusions or specifications required by you or any authority.

    2. Final costs, dimensions and inclusions may vary from the information provided on the Site and also may be varied by EBH without notice.

    3. EBH reserves the right to withdraw or vary any advertisement at any time without notice.

    4. Prices do not include stamp duty, legal fees or any other costs incurred with the purchase. You should obtain independent professional advice in relation to all costs that you may be expected to pay.

  4. Errors

    The Site displays a wide variety of information. Although EBH uses it best endeavours to ensure that the information on its Site is correct, there may be times where errors or omissions have unfortunately been made and therefore EBH does not warrant that the Site will be error-free. In that regard:

    1. EBH reserves its right to correct any such errors or omissions without any claim being made against it; and

    2. you acknowledge that any reliance upon any advice, opinion, statement, advertisement, or other information displayed or distributed through the Site is at your sole risk and EBH will not be responsible or liable for any loss or damage that results from the use of the information on the Site.

  5. Security

    Although EBH takes all steps to ensure the security and integrity of the Site, you agree that EBH will not be liable for any loss or damage you suffer by the use of the Site (including a linked website), any breakdown or interruption to the Site or the Site being hacked or otherwise being affected by any form of malicious virus or the data you receive from EBH not being secure or virus-free.

  6. Copyright and intellectual property
    1. EBH is the absolute owner of all intellectual property and contents of the Site (including all photographs, images, graphics, trade marks, video, audio, text and other items) and are protected by Australian copyright laws and other intellectual property laws.
    2. Unless otherwise expressly allowed in these terms and conditions, you must not copy, reproduce, modify, distribute, publish, display, transmit or create any derivative works from any part of the Site without the consent of EBH.
    3. You may make a single electronic copy or print a single copy of information contained within the Site for your personal use.
  7. Links to other sites
    1. EBH makes no representation about any website or content accessed through a link on the Site. The fact that the Site contains links to other websites does not constitute any endorsement by EBH of that website or the products and services being offered through that website.
    2. You agree that EBH will not be liable to you for any loss or damage you suffer by the use of any website not maintained and controlled by EBH.

  9. General provisions
    1. No delay or failure by EBH to enforce its rights or to do anything is to be taken as a waiver of that right. A waiver can only be undertaken where an authorised representative of EBH signs any such waiver.
    2. These terms and conditions and your use of the Site are governed by and must be construed according to the law of the State of New South Wales, Australia and the parties submit to the exclusive jurisdiction of the courts in that State.
    3. EBH may at any time, assign any of its rights or transfer by novation any of its rights and obligations under these terms and conditions to any person or persons by providing notice to you or otherwise publishing it on the Site. You cannot assign or transfer your obligations under these terms and conditions without prior written consent of EBH.
